This ruling also places dealers in a compromising position, Creamer noted.
“Through no fault of the dealer, who relied on past guidance, he’s now going to have to tell the customer who he sold a pistol to and explain the pistol he sold now makes the customer a felon because he’s in possession of it ‘illegally,’” he said.
Another source of consternation is the inconsistency in the point system established in ATF Worksheet 4999 (“Factoring Criteria For Rifled Barrel Weapons With Accessories”).
“What the ATF is ostensibly saying is, ‘We’ve created this point scheme and if you don’t meet the threshold of the point scheme, then you’re in illegal possession of a non-registered NFA weapon. However, if you do meet the threshold, we may decide it doesn’t matter and you’re trying to circumvent the NFA and therefore you’re in possession of a non-registered NFA weapon,” Creamer argued.
Similar to the Dec. 2020 Proposed Rule, this latest ruling has led to uncertainty, rather than clarity, Creamer contended.
“With this latest ruling, ATF has created confusion and distrust that will ripple throughout the industry for years,” he predicted.

FN Wins U.S. Army Contract For M240 Machine Guns, Receivers
FN America announced the awarding of a firm-fixed-price contract to supply the U.S. Army with M240 series machine gun variants and spare receivers. The contract, awarded through 2026, is multi-faceted, and will support both the U.S. Army and other DoD programs.
The M240 general-purpose machine gun, derived from the FN MAG 58, was adopted by the U.S. military in the late 1970s, and has been in continual service since being introduced. This contract provides a procurement vehicle for the Army to purchase multiple variants of the M240 machine gun, including the M240 coaxial, the M240B, M240L, M240D and M240H models.
“The U.S. Army contract for the M240 machine gun was the first military contract FN was awarded, and the first to be produced from our production facility in South Carolina,” said Mark Cherpes, president and CEO of FN America. “We’re incredibly honored to continue our relationship with the Army, supporting them with high-quality and reliable weapon systems for our servicemen and women.”
Throughout its history, FN has been one of the largest suppliers of small arms to the U.S. military, and the company continues to develop innovative technology. ATF Renews Attempt To Regulate Stabilizing Braces
At the close of 2020, ATF published a Proposed Rule Guidance in the Federal Register to classify firearms with stabilizing braces (“Notice on the Objective Factors for Classifying Weapons with ‘Stabilizing Braces’”) — inviting public comment from Dec. 18, 2020 through Jan. 1, 2021.
The timing of this announcement and the shortened window for comments were widely panned as a not-so-subtle attempt to legislate during what’s normally a quiet time of the year. However, thanks to more than 70,000 public comments and pushback from industry manufacturers and associations, ATF announced its withdrawal of the Proposed Rule Guidance just days later on Dec. 23.
While the industry celebrated the quick about-face, we wrote in our coverage in the Feb. 2021 issue the Proposed Rule served as a “warning sign of things to come in 2021.”
Well, June 7, ATF announced a renewed effort to regulate stabilizing braces with a Notice of Proposed Rule Making (NPRM): “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’” Unlike the December Guidance, this ruling has a 90-day comment period — which ends Sept. 8.
The ruling comes during a period of heightened tensions between the firearms industry and ATF, with President Biden’s pick to lead the bureau (anti-gun lobbyist David Chipman) facing a close, hyper-partisan confirmation battle in the U.S. Senate.
In short, the NPRM proposes amending the definition of “rifle” to clarify it includes “any weapon with a rifled barrel and equipped with an attached ‘stabilizing brace’ that has objective design features and characteristics that indicate the firearm is designed to be fired from the shoulder, as indicated on ATF Worksheet 4999.”
Additionally, ATF explains the purpose of the amendments would be to target attachments to pistols the agency contends are designed to evade restrictions imposed by the Gun Control Act (GCA) and National Firearms Act (NFA).
“When a purported ‘stabilizing brace’ and an attached weapon’s objective design features indicate that the firearm is actually designed and intended to be fired from the shoulder, such weapon may fall within the scope of the NFA, requiring registration and payment of tax,” the proposed rule reads.
As currently written, millions of law-abiding consumers would suddenly find themselves felons overnight if this rule advances. Additionally, it would have significant implications for the industry as a whole.
To gain additional insights, SI sat down with Jeff Creamer, president and CEO of SB Tactical — who argued this move represents a blatant attack on the industry and called on industry companies and gun owners to get involved and make their opinions known.
The Ruling’s Ramifications
Known as the originator of the forearm pistol stabilizing brace, SB Tactical is firmly entrenched in this segment — which has grown into a formidable economic force with dozens of companies involved in the production and deployment of pistol stabilizing braces, to the tune of over $1 billion a year. Creamer provided his team’s initial reaction to the ATF’s NPRM.
“Let’s call it what it is: It’s the largest executive branch firearms ban or registration scheme in American history,” he said. “To call it a proposal to regulate or put standardization on brace firearms is a fallacy. It’s strictly a registration/confiscation scheme.”
Creamer labeled this an outright attack on gun owners — rather than a “public safety issue” as argued by ATF. The numbers speak for themselves.
“The ATF is citing a public safety issue, but yet they can only cite two crimes committed with a braced firearm,” he shared. “The Congressional Research Service estimates there are between 10–40 million firearms in circulation with pistol stabilizing braces. While ATF estimates it to be 3 million, let’s do the math: two incidents out of 3 million? Come on.”
A significant problem facing the millions of lawful owners of pistol stabilizing braces: the ATF’s NPRM rejects grandfathering.
“This leaves millions — millions — of lawful gun owners who relied on ATF guidance in the past with few options,” Creamer stated. “They can add a longer barrel to their firearm, surrender their firearm to ATF, remove the brace and destroy it, but only if they assembled the gun themselves, or pay a $200 tax stamp and wait nine months to a year — or what will likely be years if all are submitted at once.”
“Ultimately, this isn’t just a brace issue: It’s a fundamental attack on the industry and law-abiding consumers. Every channel — OEMs, distributors, dealers and consumers — is impacted. This has got to resonate with every gun owner and every dealer.”

Soliciting Support
Back in December, when the ATF rescinded its notice, the industry celebrated this as a “win.” When asked what would constitute a “win” in this situation, Creamer noted two sides to the equation.
“If ATF withdrew the NPRM, it would be a win. But they also would view it as a ‘win’ because they’ve sown so much confusion into the market. People in general are going to be less anxious to embrace the category because it’s going to happen again.”
Creamer continued, “A ‘win’ for the industry would be reasonable, clear metrics on defining a brace and braced handguns so a manufacturer, end user or dealer could look at a weapon and say ‘that’s a handgun’ or ‘no, that doesn’t fit the criteria, that’s an SBR.’ But I don’t foresee ATF giving that up.”
As of mid-July, there were well over 100,000 public comments submitted on this rule. Noted earlier, the comment period runs through September 8, and Creamer encouraged dealers to be involved in education efforts and solicit support.
“Taking the opportunity to use the system, in this case the APA [Administrative Procedure Act] and rulemaking process for people within the industry and end users to comment why this is wrong is very important. This is why the process exists — otherwise they could have simply made the rule and that would be it,” he said.
Creamer emphasized this isn’t just an attack on SB Tactical or other brace manufacturers. This segment, which includes firearms manufacturers, OEM manufacturers, barrel makers, handguard producers, machinists and other businesses, has a far-reaching economic footprint.
“Ultimately, this isn’t just a brace issue: It’s a fundamental attack on the industry and law-abiding consumers. Every channel — OEMs, distributors, dealers and consumers — is impacted. This has got to resonate with every gun owner and every dealer,” he concluded.

Smith & Wesson Reports Record Figures
June 17, Smith & Wesson Brands Inc. announced financial results for the fourth quarter and full fiscal year 2021, ended April 30, 2021. August 24, 2020, the company completed the previously announced spin-off of its outdoor products and accessories business.
Quarterly net sales were $322.9 million compared with $193.0 million for the comparable quarter last year, an increase of 67.3%. Full year net sales were $1.1 billion compared with $529.6 million for the prior year, an increase of 100% — and the first time the company achieved this figure in its 169-year history.
Mark Smith, S&W president and CEO, heralded the company’s performance.
“Our employees more than doubled the prior year sales, passed a milestone of $1 billion in revenue and by every financial and operating metric, have delivered the most successful year in the 169-year history of the company,” he said.
Smith shared Smith & Wesson achieved significant market share growth over the past year.
“During the past fiscal year, the U.S. firearms market experienced record growth of 42%, meanwhile shipments from Smith & Wesson far surpassed the industry, growing by 70%,” he noted. “Strong consumer preference for our products combined with our ability to rapidly react to the increased demand has placed us in a clear leadership position as we enter into our first full fiscal year as a standalone pure-play firearms company.”
Celerant Technology Enhances FFL Retail Software
Celerant Technology is now utilizing SMS text-message marketing. Dynamic, trigger-based text messages now can be created and sent to individual shoppers through Celerant’s FFL point of sale.
“Not only does this allow dealers to engage with customers more effectively, it allows them to communicate using channels customers are already comfortable and familiar with,” said Ian Goldman, president and CEO of Celerant Technology.
With Celerant’s FFL point-of-sale software, text messages can either be automated or sent manually, as needed. Within a customer transaction, cashiers have the ability to select the appropriate message to send to a customer to notify them of status updates in real time.
Messages can also be sent automatically based on triggers and account activity occuring in the retail system, such as earned membership rewards, repair updates and reminders for shooting range reservations. Triggers will be expanded in a future release to include upcoming sales, delayed orders, rental returns and more.
Celerant includes several out-of-the-box text messages, and additional messages can be easily created from within Celerant’s back-office suite. Dealers can personalize messages using parameters that automatically pull and display data from Celerant’s retail database. These might include first name, coupon code, club name, reward points, work order number and more.
Messages can also include hyperlinks, making it easier for customers to access rewards, download coupons, write an online review, reserve a lane and even follow the dealer on social media.
For automated text messaging, triggers can be created to recur daily, monthly or yearly, and every minute for almost-real-time messaging and marketing.

Primary Arms Optics announced its SLx MD-25 Micro Red Dot with ACSS CQB Reticle has been recommended for duty use by the National Tactical Officers Association (NTOA) following extensive testing.

Beretta Shotgun Selected By Pa. Game Commission
Beretta USA, a member of the BDT alliance, announced a contract to supply the Pennsylvania Game Commission with 250 customized Beretta 1301 Tactical shotguns, following an extensive testing and evaluation process. The agency began fielding the shotguns in May.
“The Pennsylvania Game Commission is excited to make this transition from our legacy pump shotgun. Concealment Express Acquires Armordillo Concealment
Concealment Express (CEX) has closed a deal via its mergers and acquisitions arm, CEX Ventures, by acquiring Armordillo Concealment — a holster company specializing in Kydex weapon- mounted-light holsters.
As part of the acquisition, Armordillo Concealment Founder Anthony Booth has joined CEX in a product design capacity. The deal comes at a pivotal time for Concealment Express, which has been expanding its manufacturing capabilities rapidly over the past year.
“The combination of Armordillo’s patented holsters and our in-house manufacturing capabilities provide our customers an expanded Kydex holster offering,” said Ben Jimenez, CEX co-founder.
CEX will utilize the Armordillo’s existing patented designs, bringing manufacturing in-house at their production facilities in Jacksonville, Fla.

TROY Industries Relocates To Tennessee
TROY Industries is relocating its headquarters and manufacturing plant from West Springfield, Mass., to Clarksville, Tenn. The five-year, $7.2 million project began in June.

Davidson’s Announces Trio of Pietta Exclusives
Davidson’s has teamed with Pietta, Italy, to create three exclusive offerings.
Following on the success of Davidson’s Exclusive single-action 1873 revolvers made available June 2020, Davidson’s now offers two more variants of the 1873 Western.
These new Davidson’s Exclusives are convertible models in that each comes with two cylinders — one chambered in .45 Colt and one in .45 ACP. Offered in a 4.75″ and a 5.5″ barrel, they both feature a deep blued finish on the frame, cylinder and barrel. The trigger guard, frontstrap and backstrap are a high-polished brass.
The sights are the open fixed type with a notch at rear and a bladed front. These 1873 models feature the traditional four-click hammer.
The companion piece to these new single actions is the 1878 Double Barrel Deluxe Coach side-by-side shotgun. Chambered in 12 GA, it features 20″ barrels, walnut stock, 2.75″ chamber, color case-hardened receiver, fixed cylinder choke, bead sight, double trigger and double working external hammers.

Remington & Partners To Build Youth Sporting Clays Course
Remington Ammunition, in partnership with the Arkansas Game & Fish Foundation, was named the recipient of a MidwayUSA Foundation Range Development Grant. The grant has been awarded to the Arkansas Game & Fish Foundation and will be used at the Remington Gun Club facility to build a new sporting clays course. This state-of-the-art facility will be open to youth as well as shooters of all ages. It’s slated to open late-summer 2021.
“Remington looks forward to hosting thousands of youth shooters for future events at our gun club,” said Jon Zinnel, Remington Ammunition conservation program manager. “Without the grant from the MidwayUSA Foundation and the support of the Arkansas Game & Fish Foundation, building this new course wouldn’t have been possible.”
The clays course will be the newest addition to Remington’s historic Gun Club, a public trap and skeet club located at the Remington Ammunition plant in Lonoke, Ark. The club, soon expanding to include a retail store, welcomes thousands of shooters annually.
“Remington Ammunition’s addition of a sporting clays facility will provide Arkansas youth with a top-notch sporting facility to practice and compete,” said Deke Whitbeck, president of the Arkansas Game & Fish Foundation. “We look forward to our partnership with Remington Ammunition and introducing thousands of Arkansas youth to another clay target shooting opportunity.”
